2.1.1. The term ‘Percy & Pop’ or ‘us’ or ‘we’ refers to the owner of the website.
2.1.2. The term ‘you’ refers to the user or viewer of our website or any person using our website to buy products from us.
2.1.3. “Order” means an order or purchase of a Product by you through the Website;
2.1.4. “Order Confirmation” means our acceptance and confirmation of your Order;
2.1.5. “Product” means any of the products available for purchase on the Website;

3.2. At our absolute discretion we reserve the right, from time to time, with or without notice to you, to make any amendments and changes to these Terms and Conditions. The current version of the Terms and Conditions as displayed on the website when you access it will be fully applicable to you. Your use of the website or continued use after changes are made means that you agree to be bound by such changes.
3.3. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

- Our Products
5.1. Details of our products are contained on our website, including their ingredients and functions.
5.2. Care when using our products:
5.2.1. Before using our products you should always check the ingredients carefully and apply a small amount of each product to a non-visible area of skin and confirm there is no adverse reaction before any further application.
5.2.2. You should avoid the eye area with all of our products and in case of contact with eyes rinse immediately with water.
5.2.3. All of our products are for external use only. If any product is accidentally ingested please seek medical help immediately.
5.2.4. Children should never use our products without adult supervision. Our products must be stored out of reach of children at all times.
5.2.5. We are unable to guarantee that our products are completely free from allergens. If you are unsure about whether a particular ingredient is suitable for you or your child please seek qualified medical advice and do not use the product. No information provided on our website, in our advertising or on our product packaging constitutes qualified medical advice.
- Creating an Account
6.1. You will have an option to create an account when you purchase any products from our website.
6.2. You are only allowed to create one account. You acknowledge that if you create more than one account and we incur time cancelling any duplicate accounts we are entitled to charge an administration fee as stated in section 7 below.
6.3. You agree to ensure that all information in your account is updated regularly with any relevant changes, including change of circumstances, addresses, contact information and billing details.
6.4. At our absolute discretion, and without giving reason, we may refuse or cancel any application to create an account.
6.5. You are entirely responsible for all purchases and amendments to your account. We recommend you keep your user credentials and password secure. If you know, or suspect, that your account has been accessed by someone else, or that it is possible that it could be, you must immediately notify us.
6.6. You are entirely responsible for maintaining the confidentiality of your account and password. We will not be held liable for any loss or damage that may result from your failure to do so.
6.7. Accounts with us are not transferable and therefore cannot be sold or traded.
- Administration Fee
7.1. We reserve the right to charge an administration fee of £20 to cover our costs to amend orders, accounts and FOI requests.
- Website Availability
8.1. We do not guarantee that our website will be available all of the time and/or be free of faults and errors. If a fault occurs in the service, please report it to us and we will correct the fault as soon as we reasonably can.
8.2. Our website may not always be available. If you visit our website and it is temporarily unavailable (i.e. less than 48 hours), our usual cancellation deadlines will apply.
8.3. If our website is unavailable due to planned maintenance or business holidays or closure, we will advise you via a notice on the homepage. We will also provide information regarding order time and cancellation deadlines in these instances.
- Offers and Promotions
9.1. We may on occasion promote introductory offers. These may take many forms including, but not limited to, discounts, free products and free trials. Apart from where it has been expressly stated, previous customers do not qualify. Each account and individual can only use each discount or promotion once.
9.2. If you misuse a discount code, we retain the right to cancel the discount and charge full price to the order as well as an administration fee.
9.3. Special terms, conditions and exclusions apply to each individual offer. Please check specific offers for further details.
9.4. Where an order is made using a special promotion, delivery may be delayed beyond our usual time frames.
- Delivery
10.1. Orders can only be delivered to full and correct addresses. You are responsible to check and confirm that the delivery address we hold on record for you is accurate and complete. If we are unable to deliver your order due to an incorrect address, we reserve the right to charge a re-delivery charge plus an administration fee.
10.2. You agree that we are not responsible for any delays, which relate to the delivery of orders.
10.3. You agree to report all lost or undelivered orders within 7 days of the expected day of delivery, via www.percyandpop.com/pages/contact or by email hello@percyandpop.com If you fail to inform us within 7 days of the expected day of delivery you will contractually be deemed to have received the order.
10.4. If your order will not fit through your letterbox it is possible that the courier will leave you with a delivery card detailing the location of your order. It is your responsibility to collect the order or to arrange re-delivery.
10.5. If your order is returned to us as you have not arranged to collect it, we will not issue a refund. We also reserve the right to charge a re-delivery charge plus the Administration Fee.
- Refunds and Defective Goods
11.1. If you are not entirely satisfied with any product you receive from us, please contact us at www.percyandpop.com/contact-us so we can arrange a return
11.2 Unless a product is defective refunds are at our sole discretion.
11.3 Where a product is defective we will only issue a refund for that product.
11.4. We will not issue any refunds for any promotional products including but not limited to promotional storage tins.
11.5. Where a product is free and you pay for postage and packaging only, we are unable to issue a refund for the postage and packaging charge if you wish to return the product.
11.6. You are liable for the cost of return postage. We always recommend using a signed-for delivery method.
- Limitations on liability
12.1. Our liability for any defects in our products, service or gift sets is limited to the amount you have paid for that specific product, service or gift set to a maximum of £50.
- Applicable law
13.1. Your use of this website is governed by these Terms and Conditions and construed and enforced in accordance with the laws of Northern Ireland. Disputes arising from your use of this website and the services we provide are subject to the non-exclusive jurisdiction of the courts of Northern Ireland.
- Assignment by us
14.1 You agree that we may assign any of our rights and/or transfer, sub-contract or delegate any of our obligations under these Terms and Conditions. These Terms and Conditions are personal to you and you may not assign any of your rights or transfer, sub-contract or delegate any of your obligations under these Terms and Conditions.
- No waiver
15.1. If we delay exercising or fail to exercise or enforce any right available to us under these Terms and Conditions, such delay or failure does not constitute a waiver of that right or any other rights under these Terms and Conditions.
- Force majeure
16.1 We will not be liable to you for any lack of performance, or the unavailability or failure, of this website or our services, or for any failure by us to comply with these Terms and Conditions, where such lack, unavailability or failure arises from any cause reasonably beyond our control.
- Third Party Rights
17.1 Nothing in these Terms and Conditions confers on any third party any benefits under the provisions of the Contracts (Rights of Third Parties) Act 1999.
